Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Broker Buy Box website, tools, and platform (the “Service”), operated by Simple Software LLC(“Broker Buy Box,” “we,” “us,” or “our”). By accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What Broker Buy Box is — and is not

Broker Buy Box is (a) a free informational tool for real-estate investors and home buyers that estimates whether a property may generate enough rent to cover a typical investment-property loan payment, and (b) an advertising and marketing-software platform for licensed mortgage professionals. Broker Buy Box is not a lender, mortgage broker, real estate broker, or financial advisor. We do not originate loans, arrange or negotiate financing, make credit decisions, set loan terms, or take part in any loan transaction. All financing is provided by independent, licensed third parties subject to their own underwriting, appraisal, and approval.

How we are paid. Mortgage professionals pay Broker Buy Box a flat monthly subscription fee for advertising and software — exclusive marketing territories (ZIP codes), a branded storefront, and access to consumer leads who have asked to be contacted. These fees are for advertising and software only. They are never a referral fee, a fee for an introduction, or contingent in any way on whether a loan closes, the terms of any loan, or the volume or value of any business that results. We are not paid by, and do not share fees with, any lender, and we never charge consumers. This is an advertising/marketing model (similar to a listing or lead-advertising service), not a referral-fee arrangement.

2. For licensed mortgage professionals (territory subscriptions)

If you purchase a territory subscription, you represent and agree that:

• You hold an active, valid license (including an NMLS identifier where applicable) to conduct mortgage business, and you will keep it current. You authorize us to verify your license, and you certify that the license information and states you provide are accurate.
• You may only purchase and operate territories in states where you are licensed. You are solely responsible for ensuring your activity in each territory is lawful and within the scope of your licensure.
• Your subscription is a flat monthly advertising and software fee, billed per ZIP code; you may cancel at any time. The fee is not a referral fee and is not contingent on any loan, closing, or its terms.
• Territories, storefronts, and leads are marketing access only. We do not guarantee the number, quality, accuracy, or closing of any lead, or any return on your subscription.
• You are solely responsible for your own compliance when contacting and serving consumers — including licensing, RESPA, TILA, the TCPA and obtaining consent for calls and texts, advertising, privacy, and fair-lending laws, and your agreements with any wholesale lender or capital provider.
• You will not represent that Broker Buy Box is your employer or lender, or that it originates, arranges, or brokers loans.

We make the platform available to licensed professionals nationwide where permitted, and we may decline, suspend, or limit availability in any state or for any account at our discretion.

3. Estimates only — no professional advice

Rent figures, payment estimates, debt-service-coverage (DSCR) ratios, cashflow numbers, down-payment amounts, house-hack figures, and any “personalized plan” produced by the Service are estimates generated from third-party market data and general program assumptions. They are illustrative only, will not match actual loan terms, and do not constitute financial, investment, tax, legal, or real estate advice. You should independently verify all figures and consult qualified professionals before making any purchase or financing decision.

4. Contacting you and lead submission

When you submit your contact information through the Service, you authorize Broker Buy Box and the licensed mortgage professional(s) to whom your inquiry is routed to contact you about your inquiry by phone, email, and — if you separately check the consent box — by text message (SMS), including through automated means, at the number and address you provide. Message and data rates may apply. Consent is not a condition of any purchase. You may opt out of calls and texts at any time (reply STOP to texts), and unsubscribe from emails using the link in any message. See our Privacy Policy for details.

5. Property and market data

Property listings, prices, rent comparables, and related data are provided by third-party sources and may be inaccurate, incomplete, or out of date. Listings may change or sell at any time. We do not warrant the accuracy, completeness, or availability of any property or data displayed.

6. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for use in the United States.

7. Acceptable use

• You may not scrape, crawl, harvest, bulk-download, or systematically extract data from the Service, or build a competing dataset from it.
• You may not use the Service for any unlawful purpose, to infringe others’ rights, or to interfere with or disrupt its operation or security.
• You may not misrepresent your identity or licensure, or submit another person’s information without their permission.

8. Intellectual property

The Service, including its content, design, text, and software, is owned by Simple Software LLC or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to use the Service to evaluate properties and, for active subscribers, to operate the territory and storefront you have purchased. All other rights are reserved.

9. Third-party links and services

The Service may link to or interoperate with third-party websites and services that we do not control. We are not responsible for their content, practices, or policies, and your use of them is at your own risk and subject to their terms.

10. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate, lead, or data will be accurate or productive.

11. Limitation of liability

To the fullest extent permitted by law, Simple Software LLC and its officers, members, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the fees you paid us in the prior three months or one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify and hold harmless Simple Software LLC and its partners from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or — for mortgage professionals — your contact with or service of consumers and your compliance with applicable law.

13. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Colorado.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
